Judicature in Parliament, [ca. 1660].

Manuscript, in a single secretary hand, describing the proceedings and powers of Parliament and the King in cases of impeachment and treason, using examples of cases from the reigns of Edward III to Charles I. The manuscript explores such questions as who has the power to judge peers; the role of witnesses; and whether the King must be present. In exploring whether bishops can be judged by their peers or by "temporal lords", the manuscript cites the House of Common's accusation of Thomas Arundel, Bishop of Canterbury, of treason during the reign of Richard II. The manuscript also describes the trial of Richard Lyons, a London merchant impeached by Parliament in 1376, as the first instance of impeachment proceedings in law. Other cases used to explore Parliamentary proceedings and powers include those of John Digby, Earl of Bristol; Sir John Mortimer; William de la Poole; Sir Ralph Ferrers; Roger Mortimer; and Henry Percy, Earl of Northumberland. The volume also includes a list of cases in which judicature belongs to Parliament.
